Contract & Client Questionairre Page.

Thank you for trusting me to capture your life, through my lens. So that I can best prepare, it’s important for me to gather some information before I arrive to your shoot. This contract and questionnaire helps me to pivot the photos around your unique interactions and relationships. It’s also an essential part of my admin and creative brainstorming. Please take about 5-10 minutes to (1) please submit the contract and (2) answer the following questions. Skip any that don't apply by writing N/A, but the more information you can share, the more thought I can put into making your photos ‘you’. If you have any questions feel free to contact us.

CLIENT CONTRACT

This agreement is made by Hayley Durack at Hayley Durack Photography (Photographer) and Client (listed below the contract).


1. DEFINITIONS

'Assignment' refers to the related photography shoot and the creation of digital photographs that the Client is specifically commissioning the Photographer to create. 'Work' refers to all photographic images, digital files, prints or other materials created by the Photographer while performing the Assignment.

 

2. SCOPE OF WORK Photographer Hayley Durack is commissioned by the Client to shoot documentary-style, family images as per the package outlined in the invoice. The work will include post-production such as photo editing, basic colour-correction and quality control of tones and contrast. Deliverables are given to the Client in the form of an online private gallery featuring 90-120+ final, edited, high-resolution source files (JPEGS). These JPEGS are available for the Client to download and save.

 

3. FEES & EXPENSES

Your chosen package is outlined in the invoice. Any extra expenses, related to long-distance travel, such as air or train tickets and taxi transfers will be listed on your initial quotation and billed after your session. If detailed photoshop retouching is requested after the delivery of the completed Assignment, this can be arranged for the Client at ¥8,000 per hour (retouching rate).

 

4. PAYMENT SCHEDULE

An initial payment of 50% of the agreed package is due before the commencement of the Assignment. This deposit secures your booking. The final 50% is due before the release of the completed Assignment via online digital gallery (approximately two weeks after your session).

 

5. COPYRIGHT, INTELLECTUAL PROPERTY & USAGE RIGHTS

The Photographer shall maintain copyright privileges to the images taken. Copyright is owned by the Photographer and international copyright laws protect the images created by the Photographer. The images created may be used for the Photographers portfolio, website, social media and competition purposes. The Photographer gives full usage rights to the Client to use the images for personal use. Usage rights are transferred from the Photographer to the Client once the Assignment has been paid in full.

 

6. CANCELLATION / POSTPONEMENT

The Client agrees to notify the Photographer of cancellation or postponement at least 48 hours prior to the Assignment date in order to minimize the Photographer’s loss of income.

 

7. CO-OPERATION ON ASSIGNMENT

Every effort is made by the Photographer to accommodate the Client and their family. While on Assignment, in order for the Photographer to achieve the highest professional standard, all participants co-operation is vital.

 

8. LONGEVITY OF DIGITAL FILES. 

The Photographer does not warrant the longevity of any digital media or files delivered to the Client. The Client bears the responsibility for backing up, archiving, and maintaining the integrity of their own digital images.
